VTB24 has put up for auction more than a hundred collateral objects. How much is their price lower than the market price and is it worth buying apartments at bank auctions?
Banks have a difficult time. With the onset of the crisis, they issue less loans, but they have a lot of unnecessary property: cars and apartments - pledges received on default loans. “Today there is more realizable collateral, which was secured for loans,” says Denis Dyachenko, head of the DeltaCredit Bank's overdue debt management department.
At the same time, in contrast to previous years, the number of voluntary refusals from property has increased: clients are trying to solve their problems themselves by selling apartments, says Dyachenko. The fact that more and more objects of debtors are leaving the auction is evidenced by the data of the Federal Bailiff Service (FSSP). According to them, over the past period of 2015, 20 times more residential real estate (houses, apartments) was put up for public auction than in the same period in 2014: 13,045 and 653 objects, respectively. The situation is similar in the field of motor transport: 862 objects in 2014 and 17 438 in 2015.
Public auction
Due to the growing number of collaterals, banks are forced to look for various ways to sell apartments and cars. VTB24 decided to auction off its collateral, which it had never done before, and announced the sale of about a hundred of its properties at auctions. One part of the auctions will be in full-time form, the other - in absentia (through the "Single Electronic Trading Platform"), and the objects on them are different and the auctions will be held at different times.
During the auction, it will be possible to buy residential or commercial real estate, as well as vehicles - special equipment (dump trucks, truck cranes, trucks) and cars. There are 106 such objects in total, 43 of them are cars, according to the bank's press service. Everything else is real estate in Moscow and the Moscow region. The spread in the value of objects is huge. You can participate in the auction for a one-room apartment on Marshal Kozhedub Street (Lyublino metro station), the starting price of which is 5.9 million rubles. Or you can - for a four-room apartment in Zachatyevsky Lane in Moscow for 80.9 million rubles.
However, the bank itself is asked not to link the decision to hold auctions with the problems of its debtors. “Our borrowers did not pay worse on loans, this is an attempt to remove from the balance sheet the objects that were“ delayed ”there, - said Andrey Osipov, senior vice president of VTB24 Bank. Instead of lowering the price on them, the bank chose to try to sell them in the auction and see what happens, he explains. The start of trading is scheduled for December 23.
There will be two types of auctions, the bank's press service explains: for an increase and for a decrease. The procedure for the former is well known: bidders are encouraged to raise the initial purchase price by an auction step; the one who offers the highest price wins. Lower auctions are arranged a little more complicated: with each step of the auction, the price decreases, and any participant can stop it by placing a purchase order. Summing up the results of face-to-face auctions is planned in February 2016, electronic trading for a fall (for real estate) - at the end of January - mid-February next year.
Individuals, individual entrepreneurs and companies can participate in the auction. The requirements for everyone are the same: first, you need to send an application to the bank to participate in the auction, attaching a copy of your passport and a notarized consent of your spouse to participate in the auction. Then pay a deposit to the bank account (if the auction is in-person) or on the electronic platform (during online trading). To participate in an electronic auction, you must also obtain an electronic signature. This can be done in one of the certification centers accredited by the Ministry of Telecom and Mass Communications. Whether such a service will be paid is up to the center itself, according to the ministry's website. In addition, in both cases, to participate in the auction, you need to make a deposit, which is approximately 10% of the value of the lot.
Not just auctions
Selling collateral at auction is not the most popular strategy for large banks. Most of the top ten banks in mortgage loan portfolio prefer to sell property in other ways. Raiffeisenbank tries to look for buyers itself, and if nothing comes of it (for example, the liquidity of real estate is low), the bank attracts real estate companies, says Stanislav Tyves, head of the risk management department of individuals at Raiffeisenbank. Bank "DeltaCredit" also sells collateral objects itself, said Dyachenko. According to the same scheme, they operate in Rosbank, according to the press service of the credit institution.
A similar situation is at Otkritie Bank: the bank publishes information on collateral objects on its website. Any individual or legal entity can buy them, no advance payments are required, says Andrey Velichko, director of the department for working with distressed assets of Otkritie Bank. He admits that sometimes an element of the auction may be present: for example, if there are several who want to buy an item, it goes to the one who offers the best price. However, debtors' property is rarely transferred to the bank's balance sheet: as a rule, problem borrowers are persuaded to sell their property out of court, Velichko added.
Of the dozens of banks surveyed, only Absolut Bank admitted to organizing the auctions. He sells pledged objects in two ways: either he allows the debtors to do it themselves, or puts them up for public auction, according to the bank's press service. They are held only in person, while at least ten days before the start of the auction, the bank announces the auction. To become a member, you need to make an advance payment: 5% of the initial price of the object. For the auction to be considered valid, there must be at least two such applications. If a person manages to buy a lot, this amount goes towards payment for the purchase. If not, the deposit is returned. Over the past year, Absolut Bank put up 120 collateral objects for such auctions, nine of them in November, the press service said. As a rule, buyers were able to get objects at the initially declared price or slightly more expensive - during the auction, lots rose in price by 20-150 thousand rubles.
Ambiguous benefit
The price of objects offered by VTB24 is approaching the upper limit in its segment, notes Natalya Kruglova, director of the Real Estate business unit at Pro Consulting Global Limited. According to her, it is not worth counting on a discount, except that a discount can be obtained if the trades are “downward”. Kruglova also noted that those who were looking for just such a property - in the same area, of the same footage - should take a closer look at the objects proposed by VTB24. In other cases, this deal is unlikely to be profitable, she concluded.
The objects offered by VTB24 are adequately assessed, agrees the manager of real estate investments and the creator of Indriksons.ru Igor Indriksons. However, this is a preliminary assessment: in order to make a final verdict, you need to get the opinion of a building engineer and an appraiser. According to Indriksons, the auction price may still be attractive, although this does not mean that you will be able to buy the object. It happens, says Indriksons, that instead of a real auction, a fictitious one is arranged: there is one real buyer and two dummies, who "raise" the price.
Other difficulties
When buying real estate at an auction, one must be aware that not everyone from whom the bank took the property agrees with this, says Roman Terekhin, Managing Partner of Delovoy Fairvater. For example, the former owner of a mortgaged apartment may refuse to leave it. It happens that the new owner finds out about this only after the purchase. In this case, he will have to deal with the old tenants on his own, the bank is not responsible for this.
There is another risk: the former owner can dispute through the court that the bank took the property altogether, and the auction procedure itself, notes Ivan Soloviev, professor at the Department of Tax and Financial Law of the Federal University under the Government of the Russian Federation. For this he has three years from the date of collection, but the court has the right to extend this period. If the foreclosure is found to be unreasonable, the new owner will have to return what was bought at the auction.
Soloviev also says that the property can be encumbered. For example, housing may be mortgaged several times, and the bank may not know about it. Finally, a former owner, minor children or people with disabilities may be registered in the apartment. The latter can be impossible to write out, says Terekhin. To avoid such problems, he advises to contact the registration authority in advance and make sure that no one is registered in the apartment. In addition, it is worth making sure that the property was taken from the previous owner by a court order, and that he does not dispute this decision.
The seizure of an apartment is one of the types of encumbrances, the possibility of imposing which exists in case of debt to the bank.
In this case, the owner does not have the opportunity to realize, donate or make any other legal actions with his own real estate.
As a result, you can find arrested apartments of banks, put up for sale by the financial institutions themselves.
Why the apartment is arrested
The main reason for the sale of arrested apartments is the situation when the apartment was in a mortgage, and the debtor did not fulfill his loan obligations in a timely manner.
As a result, the bank goes to court to take away the property from a citizen or organization for debts. But this is observed only in those situations when the amount of debt has accumulated significant, otherwise the court does not satisfy the statement of claim.
Worth knowing: there are other reasons why apartments are removed from ownership and seized. So, this happens due to tax arrears, as a result of the division of property or other situations of this kind. In this case, all actions are carried out by bailiffs on the basis of a court decision.
How to buy a mortgage apartment as collateral from a bank
Often, buyers are repelled by offers to buy a residential apartment on which the mortgage burden lies.
However, with a competent approach to this process, both sides can win.
First of all, the buyer must independently ask the bank if they have any objections to the sale of a particular apartment. This is due to the fact that it is he who will have to carry out actions aimed at removing encumbrances.
To do this, you need to check:
- Does the property have double encumbrances. Some owners manage to take an additional loan, as a result of which another financial institution will also have a claim for the apartment.
- Is there an arrest or a ban on the implementation of registration actions on real estate? All information about this is obtained in the form of an extract taken from the Unified State Register (USRR). You can take such a document through Rosreestr, MFC or the State Service portal.
But this is all extremely problematic and difficult. Another simpler option is to buy confiscated apartments in the bank itself. This is due to the fact that the pledged property becomes the property of a financial organization by a court decision.
Most banks that are engaged in the issuance of mortgage loans have a large amount of confiscation in the form of real estate, which was taken away for debt. Usually, the average cost of such objects is below the market price and the discount rate for apartments for sale is up to 15%.
Note: When buying such real estate from banks, the seller deals directly with the legal entity, which is regularly checked by the regulatory authorities. This minimizes the potential risks of such transactions.
The purchase of such an apartment is carried out in the following order:
- First, a preliminary agreement is concluded between the bank and the buyer. This document must be certified by a notary in the presence of the debtor, the representative of the financial institution and the buyer.
- Further, the bank provides several cells, where funds are put in one to repay the loan, and in the second - money for the debtor (taking into account the amount paid to pay off the mortgage).
- If there are no objections, a sale and purchase agreement is drawn up and a new owner is registered through the Federal Registration Service, and the money from the cells is transferred to the intended parties.

On the day of the auction, all documents of the participants are checked, according to the results of which a person is allowed or not. Refusal can be received only in the absence or incorrectness of the submitted documents.
Pros and cons of buying a mortgage apartment from a bank
When purchasing a mortgage apartment, there are a number of negative aspects:
- duration of the procedure;
- the ability of previous owners to challenge the sale through the court;
- cancellation of the transaction with a loss of funds, if the maternity capital was used by the previous owner for the purchase.
But there are also certain positive aspects:

- legal purity of the transaction;
