AGREEMENT on participation in the loyalty program "INVITE" (PUBLIC OFFER)
This Agreement is an official public written offer (offer)
LLC "Rigla" (hereinafter referred to as the "Organizer"), addressed to all interested parties (hereinafter referred to as the Participants), collectively referred to as the Parties, to conclude an Agreement on participation in the Loyalty Program "INVITE" (hereinafter referred to as the Program). Text of this Agreement is a public offer in accordance with article 435 and part 2 of article 437 Civil Code RF.
The subject of this Agreement is the possibility of Participants to use incentives provided by the Organizer for purchases made in its pharmacy chains, purchases of goods, works, services with the presentation of a Loyalty Program card. In accordance with paragraph 3 of Article 438 of the Civil Code Russian Federation in case of acceptance of the proposed conditions, the person accepting this public offer participates in the loyalty program "PRIVATE", by receiving, accumulating and using bonuses with the presentation of the "Member Card", becomes the Customer (Card Holder) under the agreement on the conditions set forth below.
1. TERMS AND DEFINITIONS
1.1. 1.3. "Participant"- a capable individual who is a holder of the Member's Card, who at the time of registration in the program turned 18 years old, who voluntarily agreed to join the Program, by receiving the Card and voluntarily activating it and / or using the Card. The Participant grants the Organizer the right to store, process and use his personal data indicated by the Participant in the questionnaires, transferred to the Organizer by filling out the appropriate forms on the official Program Website, at the checkout or through the Participants' call center operators. The validity period of the Card is limited by the validity period of the Program or by the Organizer's Decision.

1.6. "Bonuses" virtual conditional bonus units credited to the Participant's Bonus account in accordance with the Rules. 1.9. "Notification"- information, including of an advertising nature, transmitted to the Participant using contact information specified during registration in the Program.
1.10. "Personal account of the participant"("Personal Account") is a subsection of the Program Organizer's website, where the Program Participant can get acquainted with the status of his bonus account, receive information about additional benefits, correct / supplement the data specified during registration in the Program, activate / deactivate Notifications.

1.14. 1.16. "Program duration"- from June 01, 2017. 1.19. Information Services- for the purposes of these rules, these are services on obtaining benefits in purchasing goods, holding promotions and other information about the operation of the Rigla pharmacy chain.
1.20. Offer agreement- The agreement concluded between the Organizer and an individual in accordance with Article 435 and part 2 of Article 437 of the Civil Code of the Russian Federation, published on the official website of the Program on the Internet at www.site. The Offer Agreement is considered concluded at the time of acceptance by the Participant - an individual (Client) of the Organizer's offer.
2. PROCEDURE FOR CONCLUDING AGREEMENT (ACCEPTANCE OF THE OFFER). GENERAL PROVISIONS. TERMS OF PARTICIPATION IN THE PROGRAM
2.1. The conditions for participation are the official public offer (offer) of Rigla LLC (hereinafter referred to as the Organizer) in accordance with Article 435, and clause 2 of Article 437 of the Civil Code of the Russian Federation addressed to an unlimited number of individuals (hereinafter referred to as the Participants), collectively referred to as the Parties, and determine the conditions and procedure for participation in the "PRIVATE" loyalty program. Having made an Acceptance, the Participant is considered to have confirmed that he:

3. RULES OF PARTICIPATION IN THE PROGRAM

Card activation means that the Program Member is familiar with these rules, expresses his unconditional acceptance of these Rules and undertakes to comply with them.
By filling out the Application, having received the Participant's Card, the Participant confirms that he is familiar with these Rules, expresses his unconditional agreement with these rules (hereinafter referred to as the “Rules”) and undertakes to comply with them.

The purpose of the processing of the Participant's personal data by the Organizer is the proper fulfillment by the Organizer of its obligations stipulated by the legislation of the Russian Federation and these Rules. Ensuring participation in the Loyalty Program "INVITE" and providing the Participant with information services, including through the formation of personal offers for the sale of goods (works, services, results of intellectual activity).
The participant agrees that the processing of his personal data can be done by any methods permitted by the current legislation, including but not limited to: collection; systematization; accumulation; storage; clarification (update, change); usage; distribution (including transmission); depersonalization; blocking; destruction, as well as the implementation of any other actions with personal data in accordance with applicable law.
In the event that the Participant has provided personal data of third parties, the Participant is responsible for informing the third party about the use of this data and for obtaining appropriate consent.
Data processing can be carried out both with the use of automation tools and without their use (with manual processing).
The Participant acknowledges and confirms that, if necessary, the Organizer has the right to provide personal data to achieve the above goals to a third party. The Participant's consent to the processing of his personal data is valid until it is withdrawn by the Participant or until the Program terminates. The Participant has the right to revoke his consent to the processing of his personal data at any time by contacting the Participant by calling the hotline 8-800-777-03-03. In case of withdrawal of consent by the Participant, the Organizer stops processing the Participant's personal data within a period not exceeding thirty days from the date of receipt of the withdrawal; in this case, personal data are subject to destruction by the Organizer after the expiration of the period provided for by the legislation of the Russian Federation for their storage.
By accepting the terms of the Program, registering the Program, including when passing the Activation, as well as using the Member's Card in the future in accordance with Art. eighteen Federal law No. 38-ФЗ dated March 13, 2006 "On Advertising", Art. 44.1 of the Federal Law of 07.07.2003 No. 126-FZ "On Communication" expresses its consent to receive advertising information from the Organizer or on behalf of third parties distributed over telecommunication networks, including through the use of telephone, facsimile, mobile radiotelephone communication, e-mail , the Internet, to receive, on behalf of the Organizer, mailings via the mobile radiotelephone network by sending short text messages (messages consisting of letters and (or) characters typed in a certain sequence), including mailings of an advertising nature,
The Participant has the right to refuse to receive notifications of an advertising nature by sending an appropriate appeal by calling the hotline 8-800-777-03-03, or by making an appropriate mark in the Participant's personal account on his own.
3.4. Only one Member Card can be issued for one individual. If several Cards issued for one Participant are identified, the Program Organizer has the right to block all Participant cards, with the exception of original Map, issued earlier than others, with the cancellation of points accumulated on blocked cards.
The Program Organizer has the right to refuse an individual to register in the Program if a valid registration in the Program for this individual is found.
3.5. The Participant is identified by the presented Card. To access the personal account of the Program on the website, the Card number and phone number are used to identify the participant in the Program.
3.6. Responsibility for the safety of the Card and the use of the Card by third parties rests entirely with the Program Member. The card is the property of the Organizer and must be returned upon his first request.
3.7. The organizer has the right to suspend the card and cancel the bonus account in unilaterally in cases of unfair use of the Card by the Program Participant, including when the Participant provides inaccurate registration data.
3.8. The Participant has the right to terminate participation in the Program at any time by using the exit form from the Program in the Participant's Personal Account or by calling the hotline 8-800-777-03-03. If the Participant withdraws consent to the processing of personal data in the manner prescribed by clause 3.3. of these Rules, such a withdrawal is equivalent to the Participant's application to withdraw from the Program. Participation in Participant's Program who has withdrawn his consent to the processing of it personal data, terminates at the moment of termination of the processing of personal data in accordance with clause 3.3 of the Rules, the Member's card is blocked.
3.9. The Member's cards are not credit or payment cards, they are not a means of payment. Bonuses and others accrued under the Program are not cash equivalents and cannot be exchanged for cash... Cash withdrawal from the Bonus account to the Participant is not made.
3.10. If the Member leaves the Program, the accumulated bonuses will be canceled.
4. ACCRUAL OF BONUSES
4.1. Bonuses are accrued for the purchase of Rigla pharmacy products. The organizer unilaterally has the right to determine and change the rules for calculating bonuses. As part of special promotions, additional Bonuses may be credited to the Program Participant's Bonus Account. Also, Bonuses can encourage certain actions of participants in relation to the Organizer of the Program. Bonuses become available for debiting 24 hours after accrual.
4.2. To accrue Bonuses, the Program Participant must notify the Organizer of his intention to make an accrual by presenting the Participant Card to the cashier before making a purchase. If the Program Member has not presented the Card before making a purchase, Bonuses for the purchase made are not credited. Bonuses are credited to the Card upon purchase of goods in Rigla pharmacies on the day of purchase. The Organizer is not responsible for the non-accrual of Bonuses in the event that the Participant did not notify that the purchase was made within the framework of the Program and did not present the Participant's Card.
4.3. Bonuses and rights provided to the Participant within the framework of the Program cannot be sold, transferred, gifted, assigned to another person or used otherwise, except in accordance with these Rules or with the consent of the Organizer. Bonuses have no cash value or cash value, and cannot be exchanged for Russian rubles.
4.4. Bonuses cannot be credited when purchasing goods using other loyalty programs at the same time in the check. 4.7. Additional quantity bonuses can also be obtained by participating in additional promotions. On the initiative of the Organizer, additional promotions on the provision of discounts, special prices, increased accrual of bonuses to Program Participants for a specific product or group of products purchased in Rigla pharmacies. 4.8. If the purchase is paid partly with Bonuses, partly in cash (cash or by credit card), then Bonuses are awarded only for that part of the purchase that was paid for in cash. An exception to this rule may be individual promotions of the "WE INVITE" Program.
4.9. Bonuses are not credited for the purchase of a Gift Card. If the purchase is made using a gift card, Bonuses for such a purchase are credited.
4.10. Bonuses can be used to pay for an order made in an online pharmacy (subject to self-pickup).
5. DESCRIPTION OF BONUSES
5.1. A program participant has the right to use a discount when purchasing goods in Rigla pharmacies, provided that Bonuses are debited from the card at the same time.
5.2. Debiting Bonuses from the Program Participant's Account is possible only after the Participant's registration in the Program in the manner specified in clause 3. of these Rules.
5.3. To write off Bonuses, the Program Participant must notify the Organizer of his intention to write off by presenting the Participant's Card to the cashier before making a purchase and informing about his intention to write off, otherwise the write-off will not be made, and the discount in exchange for bonuses will not be provided. When purchasing goods, the Participant voluntarily makes a choice whether he wants to use a discount on the Participant's card by writing off bonuses or use discounts provided under other programs and promotions.
5.4. The Organizer has the right to unilaterally write off Bonuses from the Participant's account in the following cases:
- erroneous accrual of Bonuses;
- return of goods for which Bonuses have been awarded;
- upon the expiration of 12 months from the date of accrual of bonuses;
- accrual of Bonuses within the framework of special promotions, with limited time expired maturities;
- in accordance with the requirements government agencies;
- accrual of Bonuses as a result of unfair use of the card.
5.5. The Participant determines the amount of the discount within the available Bonuses independently and informs the cashier upon presentation of the Card before making a purchase.
5.6. Bonuses are debited at the rate of 1 (one) Bonus = 1 (one) ruble discount.
5.7. In exchange for bonuses, you can get a discount on the entire range of pharmacies up to 50% of the purchase of goods. As part of special promotions, the discount can be increased up to 99% of the check amount.
In case of exchanging Bonuses for a Discount, the amount of the provided Discount cannot exceed the balance of the Bonuses on the Card at the time of the operation of debiting the Bonuses, and also cannot be equal to full cost purchases. In this case, Bonuses previously accrued are debited first.
5.8. When the Participant returns one or more goods from a purchase partially paid for with Bonuses, the Participant is refunded the money for the returned goods, minus the amount paid by the Participant for the bonuses from the cost of the returned goods.

7.2. The organizer is not responsible for:

- The Organizer is not responsible for any indirect / indirect losses or lost profits of the Participant, or third parties as a result of participation in the Program.
The Organizer is not responsible for the Participant's losses incurred as a result of:

The Organizer has the right to carry out preventive work in the software and hardware complex of the Program Site with a temporary suspension of the Program Site. 8. OBLIGATIONS OF THE PARTICIPANT

9. LOSS OR DAMAGE TO THE CARD

10. OTHER CONDITIONS
