— Vasily Nikolaevich, a service such as a personal account has recently appeared on the website of the All-Russian Central Committee of the Communist Party. What is it - a tribute to fashion, when many organizations open personal accounts for visitors on their websites, or is it still a necessity?
- Such a service as a personal account, we started working in December last year. We have been going to this for two years. We wanted Petersburgers to have access to their data so that they know how much and for what they pay ... In fact, this is not a revolution and not a feat. Indeed, today many organizations providing services open personal accounts ... But for a state unitary enterprise, this task was not previously considered a priority. In the context of regular changes in legislation affecting the calculation of utility bills, we first have to solve the problem of describing these innovations in software. I want to note that the VTsKP is an agent of managing organizations and does not have contractual relations with residents. Therefore, on matters of calculating rent, citizens should first of all contact the managing organization. Nevertheless, it was the right decision for us to expand our service, to help managing organizations inform citizens. It was not very easy to do this without a major software upgrade: after all, for each personal account dozens of services are taken into account, and not one or two, like many service companies. There is a forum on our site where any registered visitor can ask a question or write a complaint, express his opinion about the work of utilities. Before the personal account appeared, the forum was very active, hundreds of thousands of views were registered on some topics. Now the activity of the members of the forum has decreased somewhat, because it has become possible to receive specific information about payments on their personal account in their personal account.
- And this information is really seen only by the owner of the apartment or a neighbor, for example, out of curiosity, can look into his personal account?
- Of course not. To enter your personal account, you need to register: indicate the personal account number, date and amount of the last payment. - When a big city has an information system that provides for many visits, then some problems may arise from time to time. In virtual networks, there are cases of registered hacker attacks, when a certain person, for the sake of entertainment, finds vulnerabilities on the site and places hooligan messages there. According to press reports, this even happened on the Prime Minister's short messages page. So there is no absolute protection against such attacks yet. But if we are talking about large systems with which it works simultaneously a large number of users, then VTsKP has such experience. After all, for several years now we have been keeping a computer account of the readings of individual metering devices for hundreds of thousands of citizens through the site. And employees of managing organizations at the end of each month, almost on the same day, enter the readings of common house meters into our information system via remote access. This service is running, and there were no events related, for example, to its collapse. Therefore, the VTsKP, one might say, is a soldier on the invisible front: when everything goes well, no one notices its work. No scandals, no appeals.
“Meanwhile, more than once at the meetings of the housing committee, one had to hear that the management companies themselves give incorrect readings of metering devices. And because of such a mistake, one of the Petersburgers was even billed for water in the amount of 10 thousand rubles. Can you influence the situation to report incorrect data entry and prevent such crazy numbers from appearing on our receipts?
- Maybe I will cause indignation on the part of the readers of Vecherka, but, in my opinion, when paying by counters, no one is immune from mistakes. Neither management companies that take readings from house meters, nor the citizens themselves, who rewrite the numbers from their meters. Mistakes happen here and there. And a citizen can make a mistake and instead of 10 cubic meters show that he spent, say, one hundred, just putting a comma in the wrong place. Naturally, to conduct an instant examination and check a million testimonies (we have 17.3 thousand apartment buildings, more than 200 thousand readings of individual metering devices transmitted monthly via the Internet) is impossible. Therefore, on behalf of the Housing Committee, monthly four-level monitoring is carried out in comparison with the accruals of the previous month with the current one. This work is done before the invoices were printed. Therefore, if growth above reasonable indications is found somewhere, then this immediately becomes the subject of proceedings. The program cuts off inadequate indicators according to certain criteria, but all errors are not eliminated in this way. Without analyzing each individual situation with an overestimated volume, it is impossible to say whether this is an error or a reasonably entered reading. Nevertheless, as they say, we have all the moves recorded, the detected errors are corrected in the working mode, and if there are grounds, the citizens are recalculated in the next month's receipts.
- Vasily Nikolaevich, what should people do if they have no problems with entering instrument readings, but they receive two receipts at once with the same payment amounts? Only receipts of different colors: one is pink and the other is white. And they have different checking accounts...
- According to the law, the housing and communal services market cannot be limited by stating that you can pay rent only in one clearing center. But this freedom also has the opposite effect: it lies in the fact that since there is such an opportunity, then we will inevitably have people who want to vote in their own way and choose that management company which, in their opinion, is more suitable for this. This is easy to manipulate. And if an active, but roguish head of the Criminal Code appears, he can easily attract supporters... Such issues are within the competence of the prosecutor's office, courts and district administrations. And they are engaged in them, but not always quickly and successfully. One such example is the well-known house on Varshavskaya Street, 19. For many years, resource supply organizations have tried to get utilities or tenants money owed to them. At some stage it turns out: chairman of the HOA lives abroad, pays nothing to anyone, and all the payments collected from the tenants fall into unknown accounts. So the legally justified freedom of choice gives rise to the possibility of abuse of this freedom. As soon as we get the opportunity to buy a property that is part of apartment building, and take part in managing it through voting, so we immediately create the ground for future conflicts. But it also increases our responsibility for our property.
- What is your advice to people who received double receipts - which one should they still pay for? Or wait until law enforcement agencies sort out the conflict?
“Of course you can’t pay. But while the proceedings are going on, it is necessary to fix the existing problem legally. To do this, you must apply to the control authorities - to the housing inspection, to the local administration or to law enforcement agencies, indicating that you received two receipts for payment of housing and communal services at once. It is also worth noting which of them you consider it necessary to pay. A person who conscientiously fulfills his duties will prove his case in any case. The one who wanted to take advantage of the murky situation and did not pay anything at all, only drives the problem deeper. Moreover, those who, for some reason, do not pay utility bills, are a debtor and lose the right to receive budget subsidies and benefits.
- And if one of the receipts shows a strange bank account, will this money be lost?
- Of course, the law does not provide that any chairman of the HOA can indicate his personal account and transfer payments to it. Although the cases where accounts are indicated personal company, there are. For example, now the conflict is going on in the management company "Direct Investments", serving a number of houses in the Admiralteisky district. By the way, our wonderful people's artist Oleg Basilashvili lives in one of the houses serviced, unfortunately, by this company. As far as I know, the founders of "Direct Investments" issued a statement that they had a raider takeover and some individuals act on behalf of this company. Who is right and who is wrong will be investigated by law enforcement agencies. Unfortunately, this difficult transitional phase will have to be endured. In my opinion, it is safer to pay for the pink receipt of the VTsKP. We, as a state unitary enterprise, we split payments and transfer the necessary amounts to resource-supplying organizations. But housing payments, while there is a conflict, we accumulate. And they won't get lost. We argue like this: yes, you have a conflict, you have changed accounts. We are not an arbitrator, we are not a court and we do not decide which of you is good and which is bad. When all proceedings are completed, the legitimate recipient will receive all the money paid by citizens.
- Vasily Nikolaevich, are there any statistics: how many debtors for utility bills do we have in the city?
- According to long-term statistics, about 2 - 5% of citizens in St. Petersburg do not pay for utilities. Over the past three years, the number of debtors has decreased to 3%. It would seem a little. But if we calculate this amount for the houses located in our service area, we get 1.5 billion rubles in one year. And this is already a big amount.
- What is your forecast in connection with the economic crisis: will the percentage of debtors continue to grow?
- I hope no. On the one hand, of course, we can talk about a crisis and crisis phenomena in our economy. But with regard to utility tariffs, they do not grow like that against the background of a doubling of the value of the currency. And compared, for example, with food prices, housing and communal services tariffs do not gallop, since they are established and normalized for a long period. At the same time, if you look at the amounts that St. Petersburg residents pay today for heating, they are even declining. Our calculations showed that as soon as we switched to residents paying for heat according to meter readings, from the 2012/13 heating season, the annual savings in heat payments amounted to about 9% compared to charges according to the standard. If in numbers, then, for example, in the last heating season, instead of 16 billion rubles, which could be charged according to the standards for heat, St. Petersburg residents as a whole were billed for only 14.7 billion rubles. At the same time, there are houses in the city where savings on heating bills amounted to 30-40% during the heating period. However, in the case of long-term crisis processes, of course, there are risks of a decrease in payment discipline.
The activities of the State Unitary Enterprise "VTsKP" (Computer Center for Collective Use of the Diversified Housing Complex), which sends pink receipts to housing and communal services to Petersburgers, are practically completely illegal. This conclusion, according to the Kommersant newspaper, was made by specialists from the Control and Accounts Chamber of St. Petersburg (KSP). According to the auditors, the State Unitary Enterprise has no right to collect money either for the “communal” or for overhaul.
It is worth recalling that the possibility of urban housing and communal services without a computer center was actively discussed former lieutenant governor Vladimir Lavlentsev. It was reported that since January 1, 2015. a city can earn a single sales agent who will print receipts for all utility bills, including electricity. This reorganization is being lobbied by Inter RAO, which is led by Boris Kovalchuk, the son of Yuri Kovalchuk (Bank Rossiya). But soon V. Lavlentsev left his post, giving way to Igor Albin. According to auditors, the company also has no right to collect contributions for overhaul (VTsKP took up this at the end of last year), since a special regional law must be adopted for this, which will regulate the relationship between the settlement center and non-profit organization"The Fund is a regional operator for the overhaul of common property in apartment buildings."
The VTsKP itself denied the accusations of the auditors. “The Housing Code of the Russian Federation does not prohibit being guided by the provisions Civil Code RF on the agency functions described in Article 1005 of Chapter 52 "Agenting", - quotes the publication of the head of the development department of the VTsKP Alexander Loktionov. — The "integrated" service model of the VTsKP provides significant benefits for citizens, managers and resource-supplying organizations. Loktionov recalled that about 70% of St. Petersburg residents receive pink receipts of the VTsKP, while they are not charged additional commissions in favor of banks or terminals. At the same time, he stressed that the collection of contributions on payments of the VTsKP exceeds 80%, while the accounts of ZAO Petroelektrosbyt, which sends out receipts for major repairs to those who pay utility bills not through the VTsKP, according to data from open sources, are paid only by 20-25% of residents .
But despite this, not only the auditors, but also many of his "colleagues" are dissatisfied with the work of the VTsKP. For example, the former head of State Unitary Enterprise "TEK SPb" Arthur Trinoga said that the center's calculations are absolutely not transparent, and offered to conclude direct contracts with consumers. I. Fedorov, who replaced A. Trinoga in July 2014, supported this idea. Earlier, RBC Petersburg wrote that heat debts have been the main subject of dispute between heat suppliers, management companies and the city for several years now. As representatives of heat supply companies have repeatedly said, the bulk of overdue accounts receivable hangs on the performers of public services. About 80% of them are housing organizations with state participation, that is, subordinate to the Housing Committee. They get the money of consumers, which transfers the VTsKP. At the same time, as previously specified in TEK SPb, the VTsKP transfers money in a single stream, without specifying the payment period. And this complicates the work of determining and collecting debts from utility service providers.
Denis Fedorov, head of Gazprom Energoholding (owner of a 51.79% stake in TGC-1), even called VTsKP a "black box" last summer. “We don’t understand at all what standards he bills. We discussed this several times with the leadership of the city, we need to put things in order there, but the situation is only getting worse, ”Fyodorov said then.
At the same time, Valery Vogachev, Deputy Chairman of the Housing Committee, defended the VTsKP more than once, stating that the center only prints and sends out receipts to residents based on the data provided to it by management companies. According to him, the VTsKP always transfers money in full. As Vasily Fedotov, the head of the All-Russian Central Committee of the Communist Party, explained earlier in an interview with RBC Petersburg, the nature of the debts of managing organizations to resource supply organizations (RSOs) has several reasons. Firstly, the use in different years (before the advent of common house metering devices) of some methods for calculating the volume of utilities in relations between the RSO and managing organizations (MA) and other methods of accrual in the MA and residents. The so-called "balance" method used in the calculation of MA and RSO before 2012 had serious errors and a priori led to debts. Secondly, this is the lack of a unified system for charging fees for resources in residential and non-residential premises of apartment buildings. According to the agreements available with the MA, the VTsKP makes calculations only for residential premises. The payment for the resource consumed in non-residential premises is charged and collected by the MA or RSO without the participation of the VTsKP. Finally, thirdly, these are banal non-payers
